DOWNTOWN AXE LLC ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.

In consideration for permitting me to participate in this exciting, but potentially risky activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the directors, officers, managers, owners, employees, volunteers, representatives, and agents of Downtown Axe LLC, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me.

(B) I EXPRESSLY AGREE TO INDEMNIFY AND HOLD HARMLESS Downtown Axe LLC, to the extent permitted by law, from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of Downtown Axe LLC or otherwise.
(C) I fully understand the risks and completely assume all risks, known and unknown, of participating in these activities, including the risk of death or serious bodily injury.

(D) I agree and understand all alcohol on the premises must be authorized and provided by Downtown Axe LLC and outside alcoholic beverages are not permitted on the premises. If I elect to consume alcohol prior to or during my participation in the activities, I agree to assume all risks, known and unknown, related to consuming such alcohol and agree to be fully responsible and liable for any and all claims, demands, damages, losses, injuries, liabilities, obligations, costs or expenses of any kind which may arise due to my consumption of such alcohol (collectively the "Claims"). I hereby agree to indemnify, defend, and hold harmless Downtown Axe LLC, from such Claims.

YOU MUST BE 21 YEARS OLD TO DRINK ALCOHOL. IF YOU APPEAR TO BE VISIBLY INTOXICATED OR ARE ACTING IN AN UNSAFE MANNER, YOU WILL BE ASKED TO LEAVE!!!

(E) I have no physical or mental illness that precludes my participation in a safe manner for me or others. I am not under the influence of drugs or alcohol which impairs my ability to maintain my safety awareness or endangers others.

(F) I agree that Downtown Axe LLC, in its sole discretion, may determine it is unsafe for myself or others to participate or continue to participate in any axe throwing activities or other activities offered by Downtown Axe LLC on the premises owned or leased by Downtown Axe LLC, and that if need be, may have me removed from the premises by any means necessary.

(G) I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

(H) RULES & EXPECTATIONS. I agree that my right to participate in axe throwing and any other activity offered by Downtown Axe LLC and use of the equipment may be terminated without refund if I fail to follow posted and verbally stated rules.

I. AXE THROWING
1. NO OPEN TOED SHOES. PERIOD.
2. EVERYONE MUST SIGN A RELEASE WAIVER BEFORE THROWING.
3. INTOXICATED GUESTS WILL NOT BE ALLOWED TO THROW.
4. NO FOOD OR DRINK INSIDE THE RANGE.
5. ONE AXE PER LANE.
6. STAY BEHIND WHITE LINE IF NOT THROWING.
7. AXES MUST STAY WITHIN THE LANE.
8. NEVER HAND AN AXE TO THE NEXT PLAYER, RE-RACK AT THE END OF EACH TURN.
9. NO SWINGING, NO GESTURING, NO FLIPPING.
10. ASK STAFF FOR HELP RETRIEVING AN AXE.
11. NEVER TRY TO CATCH AN AXE THAT BOUNCES OFF THE WALL.

II. STUMP
1. EVERYONE MUST SIGN A RELEASE WAIVER BEFORE POUNDING.
2. NO FOOD OR DRINK IS ALLOWED ON THE LOG.
3. HAMMER MAY ONLY BE SWUNG DURING TURN AND AT NAIL.
4. NAILS AND HAMMER MUST BE USED FOR CORRECT STUMP PLAY ONLY. (AS POSTED)
5. MUST USE CORRECT SIDE OF HAMMER.
6. MUST NOT DESTRUCT LOG IN ANY MANNER.
7. HAMMER AND NAILS MUST STAY WITH LOG AT ALL TIMES.
8. ALL NAIL AND HAMMER USAGE REQUIRE AN ID TO HOLD UNTIL HAMMER IS RETURNED.

(I) I agree to allow Downtown Axe LLC to take a photo of me after the game and post it on their social media platforms.
The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
